如果買家律師樓send信比SC Bank對數,喺問按揭餘額係幾多,而唔係問業主在SC Bank既全部貸款餘額係幾多,咁就係買家律師樓嘅責任,係佢漏左招

假設買家律師樓係問全部貸款餘額係幾多,咁就分兩個情況,第一種情況,如果對數果刻業主係SC Bank已經有P loan,SC Bank淨係答左按揭餘額係幾多,即係SC Bank答漏野,就肯定係SC Bank責任

第二種情況,如果對數個刻個業主其實係無P loan,咁即係個P loan係對數之後先借出,咁我相信都係SC Bank責任較大,因為個mortgage都未還清無理由仲批個P loan比業主,但銀行一定推個波比業主,話審批P loan時覺得佢有能力還 (但照計over$1m P loan無可能咁易批),佢還唔到破產係業主責任,買家要自己向業主民事索償,假設法庭判業主要賠償比買家,但業主破左產,買家成為其中一個債權人,呢種情況個業主未來幾年還到幾多就幾多,但一定賠唔足

唔係好明,
按揭都未還清點解同一間銀行仲會批超過1M既P loan?
假如P loan 係按揭之前借既,
仲差銀行130萬, 點解會比佢按揭倒?

正解:買家應開票給賣家律師作 stakeholder's money 而非賣家自己,而賣家律師只能在証明賣家欠該銀行所有 (all monies) 款項,包括按揭,card 數,personal loan ... < 間樓放售價,賣家律師才可放款給賣家。
